1. Scope and Applicability
These Terms of Service ("Terms") apply to all orders placed through the Persian Essence online store (hereinafter referred to as the "Store" or "Provider"). The Store operates exclusively online and sells custom-designed products produced on a print-on-demand basis.
By placing an order, you agree to these Terms in their version valid at the time of purchase. Deviating or supplementary terms of the customer shall not apply unless expressly agreed to in writing by the Provider.

3. Products and Customization
Persian Essence offers made-to-order products such as T-Shirts, Hoodies, Canvas, and other apparel or accessories.
All products are produced only after an order is placed.
Colors, sizing, and print placement may vary slightly due to production processes.
Product images shown in the Store are digital mockups and serve as visual representations.
Such variations do not constitute defects unless they significantly deviate from the product description.
4. Offer and Contract Conclusion
The presentation of products in the Store does not constitute a legally binding offer but an invitation to place an order.
A binding purchase contract is formed when:
You submit an order via the Store checkout, and
Payment is successfully completed and confirmed.
Order confirmation emails serve as acknowledgment and do not constitute acceptance unless payment is confirmed.
The Provider reserves the right to reject orders in cases of pricing errors, technical issues, or suspected misuse.
5. Prices and Payment
All prices displayed in the Store:
Are shown in the applicable currency
Include statutory VAT where required
Exclude shipping costs unless stated otherwise

Payment is due immediately upon ordering. Orders will not be processed until payment has been successfully received.
6. Production, Shipping, and Delivery
Production
All products are manufactured on demand through Printify’s global network of fulfillment partners.
Production typically takes 2–5 business days.
Shipping
Estimated delivery times (production + shipping):
EU: approx. 5–10 business days
International: may vary depending on destination and customs processing
Delivery times are estimates and not guaranteed.
Transfer of Risk
The risk of accidental loss or deterioration of the goods passes to the customer upon handover of the goods to the shipping carrier.
7. Right of Withdrawal (EU Consumers)
Consumers within the European Union have a statutory right of withdrawal of 14 days from receipt of goods in accordance with Directive 2011/83/EU.
Exclusion of Withdrawal
The right of withdrawal does not apply to:
Goods that are made to the consumer’s specifications or
Clearly personalized products (print-on-demand items)
provided the customer was informed of this exclusion prior to purchase.

8. Returns, Refunds, and Defective Items
Because our products are made to order:
Returns due to size selection errors or change of mind are generally not accepted.
Refunds or replacements are issued only in cases of:
Manufacturing defects
Incorrect items received
Items damaged during transit
Claims must be submitted within 7 days of delivery and include photo evidence.
9. Liability
The Provider shall be liable without limitation for damages resulting from:
Intent or gross negligence
Injury to life, body, or health
In cases of slight negligence, the Provider is liable only for breaches of essential contractual obligations and limited to foreseeable damages typical for the contract.
Any further liability is excluded to the extent permitted by law.
10. Data Protection and Privacy
Personal data is processed in compliance with the General Data Protection Regulation (GDPR).
Data is used solely for:
Order processing
Payment handling
Shipping and customer support

11. Intellectual Property
All designs, images, logos, and content offered by Persian Essence are protected by copyright and intellectual property laws.
Any reproduction, distribution, or commercial use without prior written consent is strictly prohibited.
Purchasing a product does not transfer any intellectual property rights to the customer.
12. Third-Party Services
The Store relies on third-party platforms and services, including but not limited to:
Shopify (e-commerce platform)
Printify (print-on-demand fulfillment)
Payment providers (e.g., PayPal, Stripe)
The Provider is not responsible for service disruptions beyond its reasonable control caused by these third parties.
13. Amendments to the Terms
The Provider reserves the right to amend these Terms at any time. Changes will apply only to orders placed after the updated Terms have been published.
14. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Where legally permissible, the place of jurisdiction is Hamburg, Germany.
15. Severability Clause
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain unaffected.
